UNIDAD 1: INTRODUCCIÓN AL DERECHO
ACTIVIDADES
1º “El Derecho ha existido en todas las civilizaciones y existe en todas las
sociedades”. ¿Por qué?
2º ¿Tienen los países el mismo Derecho Laboral? Es decir, ¿Recogen los
países en sus textos legales los mismos derechos y deberes, las mismas
prohibiciones? Argumenta tu respuesta.
3º Observa la imagen detenidamente, está recogida de una de
las webs que tienes en la unidad 1. Busca en donde se
encuentra la imagen y di que representa y por qué aparece con
los ojos vendados, con una espada y una balanza, explicando el
significado de todo ello. Te será útil saber que representa a
una diosa y que está relacionada con la justica.
4º Investiga en internet quien fue Temi y si tuvo hijas como se llamaban y lo
que representan.
5. ¿Por qué las sociedades imponen a los ciudadanos normas coercitivas?
6. Establece todas las características de estas normas (privada o no,
flexible o no, general o especial; explicando el porqué:
-art. 29.1 ET. “el pago del salario se tiene que realizar en el lugar convenido
o conforme a los usos y costumbres”.
-Art. 38 ET. “el período de vacaciones anuales retribuidas no sustituible por
compensación económica será el pactado en convenio colectivo o contrato
individual. En ningún caso la duración será menor de 30 días naturales.
-Art. 6.3 ET.” Se prohíbe realizar horas extraordinarias a los menores de
18 años.

8.1 ¿Puede el gobierno regular por decreto ley el derecho a la huelga o a la
educación?, ¿por qué?
9.2 ¿Qué normas son las que hace el gobierno: enuméralas y señala sus
características más importantes.
10º El Estatuto de los trabajadores señala 15 días de permiso retribuido en
caso de matrimonio; Jesús Gutiérrez ha comprobado que su convenio
colectivo recoge 18 días por la misma circunstancia y el contrato de trabajo
que él ha firmado señala 16 días. ¿Qué norma se ha de aplicar?
11º Lucía trabajó en Cáceres como cocinera en un restaurante en el cuál
existía la costumbre de repartir las propinas entre los camareros y los
cocineros. Al llegar a Cádiz vio que no se seguía dicha costumbre y fue a
quejarse al empresario de que los camareros se estaban quedando con todas
las propinas sin repartirlas correctamente. Coméntalo.
12º Miguel va a disfrutar de las vacaciones. El Estatuto reconoce al
trabajador 30 días naturales; en el convenio colectivo del sector se le
reconocen 31días y en su contrato se pactaron 28 días. ¿Qué norma se
deberá tener en cuenta? ¿No te parece que existe una irregularidad?
Coméntalo.
13º Di que principio es aplicable a las siguientes situaciones y explícalo:
A- Un convenio colectivo del sector de la siderurgia reconoce dos días
completos de descanso laboral para los trabajadores, el Estatuto señala día
y medio; un trabajador del sector le reclama a la empresa para la que
trabaja que le permita disfrutar del descanso semanal según convenio. El
empresario se negó y el trabajador ha reclamado judicialmente.
B- Un contrato de trabajo reconoce al trabajador el pago de los trienios a
45€; sin embargo un convenio colectivo aplicable a ese trabajador que es
reciente y de fecha posterior al contrato, recoge eliminar el cobro de los
trienios, por lo que el empresario ha decidido no seguir pagándolos a ese
trabajador. El trabajador lo reclama al juzgado.
C- Un trabajador firma en contrato renunciar a 7 días de los 30 días
naturales que tiene de vacaciones al año. El empresario le exige al
trabajador que cumpla lo firmado. El trabajador se arrepiente y decide
denunciar al empresario.
14º Coloca ordenadamente las siguientes normas y di en que criterio te has

-Ratificación del Convenio de la OIT Nº 135. Relativo a la protección y
facilidades de los representantes legales de los trabajadores.
- Directiva 90/270/CEE del Consejo, de 29 de mayo de 1990, referente a
las disposiciones mínimas de seguridad y de salud relativas al trabajo con
equipos que incluyen pantallas de visualización.
-Ley orgánica de educación 2009.
-DECRETO 76/2009, de 3 de abril, por el que se establecen las bases
reguladoras para la concesión del Plan Renove de Electrodomésticos de
Extremadura
-Acuerdo Laboral Estatal del Sector de Supermercados, Superservicios,
Autoservicios y Distribuidores Mayoristas de alimentación (Código de
Convenio núm. 9914525), que fue suscrito con fecha 28 de marzo de 2003,
de una parte, por la Asociación Española de Distribuidores, Autoservicios y
Supermercados (ASEDAS), en representación de las empresas del sector y,
de otra, por las centrales sindicales FECOHT-CC OO y FCHTJ-UGT, en
representación del colectivo laboral afectado.

UNIDAD 2: EL CONTRATO DE TRABAJO
ACTIVIDADES
1º Di si las siguientes situaciones reflejan la existencia de una relación
laboral, una relación laboral especial o sencillamente esa situación no es una
relación laboral y argumenta la respuesta:
a) Javier García Garo es médico voluntario en Kenia y colabora durante
los meses de verano con la ONG “Médicos sin Fronteras”.
b) Amelia Ruíz va al bar de su tío con frecuencia para echarle una mano
en las horas de mayor trabajo, a veces su tío le da unos euros o le invita a
comer algo.
c) La relación que une a un ciclista profesional con su equipo de carreras
para disputar el tour y la vuelta ciclista a España.
d) Un trabajador alto directivo de una importante cadena de
supermercados.
e) Una limpiadora del hogar que trabaja para una familia diariamente 6
horas y cotizan por ella a la seguridad social.

2º Di como han de celebrarse (oral u escrito) los siguientes contratos y
argumenta la respuesta:
a) Un contrato de trabajo para realizar una instalación de placas solares
en las viviendas de una urbanización en construcción.
b) Se quiere contratar por un tiempo de 6 meses a un joven que no ha
terminado el ciclo Formativo de Restauración (GS) pues le ha quedado e
módulo de FOL aunque sí ha realizado ya las prácticas en empresa.
c) Contratado para hacer frente a una acumulación de pedidos en una
fábrica textil por 20 días.
d) Contratado indefinidamente a un joven de 17 años.
3º Una joven acuerda con la empresa que le va a contratar por un año que
durante los tres primeros meses esté a prueba para ver si responde a las
necesidades del puesto de trabajo. Es un contrato a tiempo completo, es
decir trabajará 9 horas diarias y durante ese tiempo ella acepta que como
está a prueba va a cobrar un 60% de lo que realmente cobraría un
trabajador de la compañía con igual categoría profesional, puesto de
trabajo e igual número de horas trabajadas que ella. Igualmente se acuerda
que al finalizar el periodo de prueba no reclamará a la empresa el cobro de
la parte proporcional de las pagas extras ni el cobro de la parte
proporcional de vacaciones que le correspondería durante dicho periodo.
Lee atentamente esta situación laboral en donde encontrarás varias
irregularidades que debes de destacar.
4º Un centro comercial va a abrir sus puertas próximamente (1-1-2010) y
necesita contratar a varios trabajadores. Comenta los errores que aparecen
en cada situación y corrígelos según las exigencias del Estatuto de los
Trabajadores:
a) Se va a contratar como aprendiz para carga y descarga a un parado de
larga duración (28 años) ya que nunca ha trabajado en este sector y
necesita formación. Se quiere firmar contrato por un año y a tiempo parcial.
La empresa le ha comunicado que la jornada de trabajo será de 8 horas
diarias más otra hora para llevar a cabo la formación del trabajador, es
decir sería una jornada de 9 horas diarias.
b) Se va a contratar en prácticas a otro desempleado que tiene el título
de Técnico Superior en Telecomunicaciones y acabó sus estudios en el año
2002. Siempre ha trabajado en tareas administrativas para la misma
empresa que ahora le acaba de contratar en prácticas y nunca en
mantenimiento de equipos informáticos; de tal modo que tiene la
oportunidad de poner en prácticas los conocimientos que adquirió en dicho
Ciclo. La empresa le ha comunicado que la jornada será a tiempo completo
porque así lo exige la ley, cobrando el primer año el 50% de lo que cobra un
trabajador de su misma categoría, con igual trabajo e idénticas condiciones
laborales.
c) Se va a contratar por circunstancias de la producción a tres
trabajadores durante 6 meses para almacén y reposición de productos. Se
les ha propuesto no firmar contrato si bien si van a ser dados de alta en la
Seguridad Social.
d) Se van a contratar varios trabajadores por obra o servicio a tiempo
parcial para la realización de unas instalaciones y su posterior
mantenimiento durante 5 años. La empresa ha comentado que es muy
probable que se conviertan en indefinidos dichos contratos por lo que no es
necesario firmar contrato, basta el acuerdo oral.
5º María Rodríguez firma un contrato de trabajo para la formación en el
Hotel Sierra Par para trabajar en la Cafetería del hotel. Señala cuáles
serían los elementos esenciales de este contrato. Busca en internet los
elementos esenciales de un contrato laboral y utiliza este caso para ponerlo
como ejemplo de cada uno de esos elementos.
6º Reflexiona y responde, para cada una de las siguientes situaciones, quién
es el responsable de firmar el contrato de trabajo: (capacidad del
trabajador)
a) Cuando Juan Martínez Ruiz tiene 18 años.
b) Cuando Juan Martínez Ruiz tiene 15 años.
c) Cuando Juan Martínez Ruiz tiene 16 años.
7º Una trabajadora empezó a trabajar para una empresa de empaquetado y
embasado de verduras en la comarca de la Axarquía el 1-11-2006. Ella ha
firmado varios contratos temporales con la misma empresa que suman ya
más de 24 meses trabajados en la misma. La empresa le acaba de proponer
firmar de nuevo otro contrato eventual por circunstancias de la producción.
Reflexiona sobre esa situación y di qué señala el legislador al respecto.
8º Una ETT ha contratado a un trabajador para sustituir a otro de una
empresa el cual lleva una semana en huelga. Así mismo dicha ETT ha
contratado temporalmente (3meses) a un trabajador que, pasado dicho
plazo, continúa prestando sus servicios en la misma empresa. Esta ETT
tiene por costumbre presentar en el finiquito las cantidades salariales
adeudadas (paga de la parte proporcional de las pagas extras y la
proporcional por vacaciones) y nada más, es decir sin indemnización alguna.
Comenta los errores.

* Un hotel, ante la celebración de unas competiciones deportivas en la
localidad, va a estar ocupado al 1oo% durante 10 días. El mismo día en que
comienza dicha actividad deportiva, el hotel recibe varias llamadas de
camareros de planta que estarán de baja por enfermedad (gripe severa)
durante una semana. El departamento de RRHH ha solicitado a LMJ y FRD
que durante ese tiempo dejen sus trabajos de camareros en el bar del hotel
y suban a la planta 2ª para limpiar habitaciones.
-¿Pueden negarse los trabajadores?
-¿Cuánto tiempo puede el empresario mantenerlos limpiando en la 2ª planta?
-Existe una diferencia considerable de salario (de camarero del bar el
salario base es 200€ mayor). ¿Puede el empresario bajarles el salario a los
trabajadores?
* Durante dichos días, el Jefe del Bar ha enfermado igualmente y estará de
baja 30 días. Uno de los camareros del Bar estará realizando las tareas de
Jefe de Bar (de categoría superior) durante dicho mes.

A continuación aparecerán varios supuestos laborales y tendrás que
determinar de qué tipo de movilidad se trata:
- LFP trabaja de recepcionista en una pensión. El compañero, ayudante
de recepción está enfermo y le han solicitado que realice las funciones del
compañero pues es temporada baja y al haber poco trabajo en el hotel no
van a pedir un sustituto.
- ARC trabaja de limpiadora en el hotel. Lleva 5 años. Una camarera del
bar está de baja maternal y le han propuesto sustituirla durante las 16
semanas de baja. Ahora pasará a cobrar 1.098€.
- IPG lleva 5 años en la cadena de una importante hamburguesería. Le
han propuesto llevar la gerencia de la nueva sucursal que se abrirá en otra
provincia andaluza en 3 meses. Le ofrecen un contrato indefinido.
- A un compañero del anterior también le ofrecen trabajar en la nueva
empresa, haciendo el mismo trabajo que venía haciendo para que enseñe a
los nuevos contratados. Tendrá que estar en la nueva sucursal solamente 3
meses.
- COMENTA SI SE VERÁN AFECTADOS O NO LOS SALARIOS DE
ESTOS TRABAJADORES ASÍ COMO QUIENES TENDRÁN DERECHO A
UNA INDEMNIZACIÓN SI QUISIERAN MARCHARSE.

Luis Jiménez Ortega, trabaja en una cafetería en el turno de mañana. Eso le
permite estudiar por la tarde en La Rosaleda un CF de Restauración (Grado
Superior). El jefe le ha propuesto que si se saca el título le subirá de
categoría y le pondrá a cargo del bar.
Luis está ya en el segundo año del ciclo. El empresario le acaba de pedir que,
por razones de organización (ha contratado a un nuevo camarero muy bueno
y con muy buen CV) trabaje en el turno de la tarde.
¿Qué situación refleja este caso: una movilidad funcional, geográfica o un
cambio sustancial en el contrato laboral?
¿Qué puede hacer Luis?
Luis gana 1.332€ mensuales netos. Está muy disgustado y decidido a llegar
hasta el final: denunciar al empresario pues está perjudicando su formación
profesional y podría haberle pedido a un compañero de la mañana que no
estudia que cambiara el turno. Luis piensa que en realidad el jefe lo que
quiere es que se vaya de la empresa y así lo hace, pero denuncia al
empresario. Imagina que Luis gana y el juez le da la razón. La empresa le
pagará una indemnización.
¿Cuánto sería si Luis hubiera estado en el bar 14 años exactos y con
derecho a dos PPEE de igual cantidad?.
ACTIVIDAD 4#
Lee atentamente los siguientes casos en que el empresario va a despedir al
trabajador. Algunos suponen un despido disciplinario y otros un despido por
causas objetivas. Señálalo:
- Javier empujó a un compañero que se cayó y rompió una determinada
mercancía. Será despedido. Llevaba 5 años en la empresa.
María aprovechó que tenía las llaves del negocio del jefe y se quedaba en la
empresa una vez que cerraba manejando los ordenadores. En una ocasión
provocó la entrada de virus que perjudicaron la información que almacenaba
el ordenador. Será despedida. Llevaba 9 años en la empresa.
- Concha lleva de contable 12 años. Siempre ha llevado las cuentas por los
métodos tradicionales. La empresa lleva preparándola para el uso de
programas informáticos 3 meses y no consigue manejarlos correctamente.
En varias ocasiones han aparecido errores importantes en la contabilidad.
Será despedida.
- En la imprenta Pirania, han introducido nuevos equipos técnicos y van a
despedir a dos trabajadores. Serán despedidos. Llevaban 22 años en la
empresa.
* ¿Cuáles de ellos cobrará una indemnización y por cuánto dinero? Imagina
que todos ellos ganaran 1.200€ mensuales netos con dos PPEE de igual
cantidad. Calcúlalas.
