About 15 years ago a flood had atremendous impact on B. VasquezFarms. A phone call was made to

the Farm Service Agency (FSA) to ask aboutdisaster benefits, but the farmers didn’t qualify.Those farmers are still waiting for help, how-ever they are not the only ones.

"We've been battling this thing so long, it'snot a money issue any more," said Jose LuisVasquez. "We might not get anything and wemight die fighting it because it's been going onfor ten years, but we’re doing it for the nextgeneration."

Vasquez and brother Bernardo Jr. went intofarming because their dad went from being afarmer to owning some acres where they grewlettuce and broccoli. They are used to beingtreated badly and believe it’s because of theirnationality.

The Vasquez brothers along with Juan Car-rillo are plaintiffs in the Garcia v. Vilsack law-suit, filed by a group of Hispanic farmersagainst the United States Department of Agri-culture (USDA). It seeks to remedy decades ofwell-documented discrimination against His-panic farmers and ranchers perpetrated byUSDA in the administration of its farm creditand non-credit farm benefit programs.

“There’s actually several minority farmerlaw suits against USDA,” said attorney ColletteI. Harell.

The first to file a lawsuit were the AfricanAmericans in 1998 during the Clinton admin-istration and by 1999 the case settled for $1 bil-lion. It also granted the farmers debtforgiveness. Meanwhile, the B. Vasquez Farmswas going bankrupt.

Harell explained that they have been in a

legal battle for nine years fighting over the issueof class certification. The judge decided that thegroup of Hispanics should be treated individu-ally.

“It's unrealistic that each farmer can go inwith an attorney and bring a lawsuit beforecourt,” said Harrell. "Bottom line is that thesefarmers are being denied justice."

After fighting for nine years, Obama's ad-ministration, the Department of Justice hasstarted to talk settlement and offered 1.3 billionto female and Hispanic farmers as a settlement.There are about 80,000 Hispanic farmers withinits group.

"I did get to see first hand discriminationthere,” said Juan Carrillo.

Carrillo served as the first minority advisorfor the county of Salinas in the USDA, but thatdidn’t interfere with his experience with dis-crimination. He saw all the applications forloans and benefits that were being denied. His-panics weren’t getting anything, he said.

Working for the USDA didn’t guaranteeCarrillo payments or loans. He has shared histestimony in Washington D.C. and strongly be-lieves that the USDA is getting rid of minorityfarmers.

"I've been working on this case for sevenyears and working with these farmers and knowthe ins and outs of what's going on and whatthey've suffered," said Collete. "It's an atrocityand these are all tax paying US citizens."

Currently, there is an offer on the table butits as good as nothing says Harrell. They aretrying to persuade the Department of Justice toagree to a settlement that is fair and just.

"The era of farming is pretty much gone forus (Mexican Americans)," said J. Vasquez."There's no way that you can get into farmingright now."

A U.S. Constitutional Crisis Is Being Created

Too many of us are bystanders whoare watching what is going on inArizona after its enactment of SB

1070 and the subsequent stay of implementa-tion by a federal judge. There are many whohave partial information and as a consequencehave not yet recognized the danger and threatthat is already upon us.

Our attention is being diverted by all thatpress and media turmoil concerning “gay mar-riage”. Several cities have adopted ordinanceswhich prohibit the rental of residences to theundocumented. Under the past Bush adminis-tration, Homeland Security Department esca-lated the raids by ICE on certain industries(packing houses, especially) which employhigh numbers of the undocumented. Employ-ers are threatened with large fines for know-ingly providing employment for theundocumented.

Go back a bit to recall those who consis-tently state that President Obama has no rightto be our Commander-in-Chief as well as ourelected Chief Executive Officer, specificallythe individual who has been elected to be ourPresident. His proof of birth in Hawaii hasconsistently been contested and undermined.Throughout the nation there have been verbalattacks by members of the Republican Party,especially their radical elements who oftencome across as being very stubborn ignorantracists. Although that is what is perceivedpublicly, if one takes all these events togetheras was done for the first time that this pub-lisher has heard, a case is being assembledwhich undermines the U.S. Constitution, es-pecially its 14th Amendment, which pro-claims and establishes that anyone born inAmerica has the birthright of being an Amer-ican citizen. Little by little, these events willadd up to a very serious challenge to the cur-rent American Constitution, especially its 14thAmendment.

Last week, the Mexican American LegalDefense and Education Fund (MALDEF)sponsored a mass at St. Joseph’s Cathedral,San Jose. MALDEF’s President and GeneralCounsel presented a brief commentary on Ari-zona’s SB 1070 legislation which was craftedto permit the use of profiling to provide locallaw enforcement agents to challenge anyonethat that agent suspected of being an undocu-mented resident who is here in America ‘ille-gally.’ It was at the fund raising reception heldafter the Catholic mass at the legal offices ofRoge Fenton Jones & Appel, Inc. that a crystal

clear presentation was made by Miguel Mar-quez, the first Latino to hold the office ofCounty Counsel, County of Santa Clara. Thisreception was sponsored by the InterfaithCouncil on Economies and Justice, South BayLabor Council, La Raza Lawyers Association,La Raza Roundtable, and the Hispanic Cham-ber of Commerce.

There is no secret that Latinos, especiallyMexicans and other immigrants across the na-tion are now facing escalating threats to stripthem of their civil rights and personal security.No place highlights this more than the SB1070 legislation, signed by Arizona’s Gover-nor Jan Brewer. SB 1070 is designed to be adiscriminatory law as well as an anti-immi-grant law. These actions, taken collectively,call for a change in attitude and awareness be-cause the rights of any human resident ofAmerica are being challenged. If allowed tosucceed, America will no longer be the cham-pion of personal freedom and democracy.MALDEF is amongst the leaders in this col-lective effort to block this Arizona SB 1070law in federal courts. Citizenship, immigra-tion issues, and the national border security(or lack thereof) is a Federal government re-sponsibility and jurisdiction. This must not beeroded by all those local jurisdictions andstates who are adopting legislation which ad-dresses citizenship and immigrant issues.MALDEF is challenging SB 1070’s discrimi-natory impact on Latinos as well as the waysit will violate the constitutional rights of bothcitizens and non-citizens.

It was in light of these relationships thatMiguel Marques, Esq. persuaded authoritiesof the County of Santa Clara to file an ‘Ami-cus Brief”. Fifteen jurisdictions across the na-tion joined in support of MALDEF. Theseincluded the Cities of San Jose, Los Angeles,Palo Alto, Berkeley, San Francisco, El Paso,Portland, Seattle, New Haven, Minneapolisand St. Paul.

Washington, DC – A new sum-mary of recent Latino voterpolls highlights the way the im-

migration debate is influencing Latino politicalengagement in the run-up to the Novembermid-terms. The lack of action on comprehen-sive immigration could dampen enthusiasmamong Latino voters at a crucial time. Accord-ing to an article in today’s POLITICO: “Theswing in opinion couldn’t come at a worse timefor Democrats, who need a strong Latinoturnout in November if they hope to maintaincontrol of Congress. That voting bloc could bedecisive in dozens of competitive House, Sen-ate and gubernatorial races across the West, ac-cording to a report by America’s Voice, animmigration reform advocacy group.”

However, the three recent polls also makeclear that national attention to Arizona’s anti-immigrant law and the negative rhetoric es-poused mainly by Republicans—like the latestflap over repealing the 14th Amendment—could, in fact, energize Latinos to turn out thisyear and punish Republicans.

According to Lynn Tramonte, Deputy Di-rector of America’s Voice, “Clearly, the currentimmigration debate—including the national at-

tention to Arizona’s anti-immigrant law—ishaving a major impact on the way Latino votersview the two political parties and the impor-tance of voting in November. While the lack ofaction on comprehensive immigration reformcould depress turnout and harm Democrats whoare most ‘on the hook’ for delivering that corepriority, the anxiety over Arizona’s anti-immi-gration law and heated rhetoric from the GOPis having a mobilizing effect on Latino votersthat could hurt Republicans in November andbeyond. While the story of the 2010 mid-termelections remains to be written, it is clear thatLatino voters and the immigration issue in gen-eral will be a key chapter.”

The polling summary highlights the resultsof three recent surveys conducted by Latino-Metrics for the Hispanic Federation and Leagueof United Latin American Citizens (LULAC);Dr. Ricardo Ramirez of the University ofSouthern California for the National Associa-tion of Latino Elected and Appointed OfficialsEducation Fund (NALEO); and the NationalOpinion Research Center (NORC) at the Uni-versity of Chicago for Associated Press-Univi-sion. El proyecto propuesto consiste en la instalación en fases de aproximadamente 10.2 millas de tubería para la distribución y transmisión de agua reciclada para terminar en las cercanías de Gilroy para sus usuarios. Las tres fases son: Fase I a corto plazo del Plan de Mejorías Capitales (o CIP, por sus siglas en ingles, Capital Improvement Plan), a corto plazo-- Fase II del CIP, y a largo plazo del CIP. Fase I (2.6 millas) se extiende desde las instalaciones existentes para el agua reciclada hasta Monterey Road en East Luchessa Avenue, y de un oleoducto existente a Cintas Corporation; Fase I se ha aprobado la asistencia financiera de la Oficina de Reclamación que se examina por separado del medio ambiente y se propone para la construcción en un futuro próximo. Fase II (2.9 millas) se extiende de la fase I a Santa Teresa Boulevard, a través del propuesto desarrollo de Glen Loma Ranch y al lado de Ascencion Solorsano Middle School (ASMS); Fase II incluye la construcción de un embalse en las instalaciones de agua reciclada existentes, y una bomba / estación de rebombeo en Christmas Hill Park. El Reporte-borrador permitirá que el distrito de agua evalue la aprobación de la totalidad del proyecto propuesto, basado en un análisis al nivel de programa (en general), y evalue la implementación de la Fase I CIP a corto plazo, basado en el análisis de cada proyecto en específica. Un aviso de terminación ha sido presentada en Repositorio del Estado para este proyecto, en cumplimiento con el Acta de Calidad Ambiental de California.

El Reporte-borrador identifica los efectos que podrían ser significativos en las siguientes áreas: las tierras agrícolas, recursos biológicos, recursos culturales, la geología y los suelos, aguas subterráneas y la calidad del agua, uso de la tierra, ruido, iluminación, y el tráfico. Medidas de mitigación propuestas reducen todos los impactos a un nivel menos que significativos. El proyecto no atraviesa los centros enumerados en la Sección 65962.5 del Government Code, incluidas las instalaciones de residuos peligrosos, propiedades de desechos peligrosos, y peligrosos vertederos.

Human trafficking can come inmany forms such as bonded labor,debt payments and the most com-

mon forced prostitution.On Thursday, July 29, community members

met with San Jose Police Department’s Lt JohnVanek at the Vineland Branch Library to dis-cuss human trafficking in San Jose.

“Slavery has been around forever and it isestimated that there are some 27 million peopleenslaved in one form or another,” Vanek said.“These people are recruited through scams andhave to work to pay off a massive debt that issometimes unachievable.”

The San Jose Police Department hasteamed up with several groups to help fighthuman trafficking. Some of these groups workwith domestic violence victims and immigra-tion issues.

“Sometimes it an be very hard to talk to in-dividuals who we believed are being traffickedbecause they are afraid they will be deported,”Vanek said.

Vanek added that it is especially hard forwomen who are victims of sex trafficking tocome forward because there is a lot of moneyto be made.

“Once a woman has paid off her debt, shehas no way of supporting herself when she ison her own. So she goes back to doing what shehas been doing to survive,” Vanek said. “Some-times she can be working as a sex worker for

twenty years.”The victims of human trafficking suffer

through depression, suicidal tendencies andseveral kinds of illnesses.

“They are also threatened with violence orthrough black mail by their traffickers,” Vaneksaid.

According to the 2005 Trafficking in Per-sons Report, 600,000 to 800,000 people aretrafficked across international borders eachyear. The United States Department of Justiceestimates 18,000 to 20,000 people are traffickedinto the United States each year. Internationally,there are many groups working to combathuman trafficking. The United States is a recententrant to this struggle. Aside from producingthe most comprehensive analysis of traffickingpersons, the United States has been successfulin encouraging countries with trafficking prob-lems to take action against it.

What to ask when you suspect a person is avictim of human trafficking: “What type ofwork do you do?” “Are you being paid?” “Canyou leave your job if you want to?” “Can youcome and go as you please?” “Have you or yourfamily been threatened?” “What are your work-ing or living conditions like?” “Where do yousleep and eat?” “Are there locks on your doorsor windows so you cannot get out?” “Do youhave to ask permission to eat, sleep, and go tothe bathroom?” “Has your identification or doc-umentation been taken from you?”

Santa Clara, CA– The HispanicCollege Fund received a $100,000donation from Microsoft, a leader-

ship gift that helped ensure the launch of theinaugural Silicon Valley Hispanic Youth In-stitute on July 28-31 at Santa Clara Univer-sity. About 100 local Latino high schoolstudents are expected to attend the four-day,three-night college empowerment programwhere they will participate in college and ca-reer workshops, attend a college admissionfair, connect with local Hispanic profession-als and college admissions officers, and com-pete for $10,500 in scholarships.

The students will receive ongoing sup-port and information in their East Side Unionhigh schools during the 2010-2011 schoolyear through the Hispanic College Fund.

“A number of community leaders wereasking us to bring the program to San Josethis year, but each Institute costs approxi-mately $150,000 to hold, and the fundraisingenvironment is incredibly challenging rightnow,” said Kathryn Grady, Hispanic CollegeFund director of corporate and foundation re-lations of western states. “Microsoft heardabout this program and our track record ofsuccess in other communities, and they tooka true leadership role. They’ve donated

$75,000 towards the program plus $25,000worth of in-kind product donations. WithMicrosoft on board at such a high level, wewere able to quickly rally other supporters inthe region and break even in our first pro-gram year. That is unheard of, especially ina recession.

In addition to their monetary contribu-tion, over twenty Microsoft employees willbe participating as volunteers during the pro-gram.

The Hispanic Youth Institute guides un-derserved Hispanic students to pursue highereducation, achieve a professional career, andbecome engaged community leaders and vol-unteers. Following a summer college resi-dency called the Hispanic Youth Symposium,all students are enrolled in year-round pro-gramming that reinforces the key themes ofthe symposium: 1) Achieve a college educa-tion, 2) pursue a professional career (with anemphasis on business and STEM), and 3) be-come community volunteers.

Doña Margarita y Celia ya están ul-timando detalles para llevar a sushijos a la escuela Merritt Trace de

San José. Pese a que un incendio de grandesproporciones destruyó una parte de este centroeducativo esto no la ha frenado sus deseos deinscribir a sus hijos en esta escuela.

“Hemos asistido a reuniones y la Directoraha sido muy amable con todos. Nos han dadotodo tipo de información y ya me quedó claroque esta lugar está seguro ”, dijo Celia, quienlleva a su segundo hijo a ser parte de esta es-cuela.

Recordemos que una parte de la escuelaprimaria Meritt Trace quedó en cenizas la ma-drugada del 5 de Julio. El incendio que fue pro-vocado-según arrojan los resultados de lasinvestigaciones- dejó sin aulas y sin bibliotecaa este centro educativo.

Afortunadamente El Distrito Unicado deSan José (SJUSD) tomó acciones de inmediatopara construir salones móviles. “El distrito habatido record construyendo las aulas. Todo estálisto para el primer día de clase. Ahora conta-mos con 21 salones. 16 de los cuales fueronconstruidos en una zona de la Escuela PrimariaHoover-escuela vecina de Trace- y otra parte seha construido en una zona apropiada de esta es-cuela” dijo la Directora, Anacelia Rocha.

Trace Elementary School ahora cuenta conuna biblioteca, sala de cómputo, cafetería y sa-lones para estudiantes del tercer grado. Sin em-bargo se siguen aceptando donativos parareconstruir esta escuela. Recordemos que sonaulas móviles que van a requerir ser reempla-zadas por salones fijos.

Several Summer Youth LeadershipAcademy (SYLA) students from theEast Side Union High School District

(ESUHSD) held a community townhall at Over-felt high school on Tuesday, August 10, to obtainrecommendations on how to ensure students areprepared for meaningful careers and a life afterhigh school .

“I want to be a successful woman of color,said Patricia Navarro. “I want to go to collegeand have a career.”

Californians for Justice (CFJ) have workedwith the East Side Education Alliance (ESEA),a San Jose coalition of community organizations,elected officials, unions, and education advo-cates, to develop a regional campaign: “A-GGraduate with Me!” The campaign seeks to en-sure that the ESUHSD implements A-G course-work as part of the graduation requirements,strengthen support programs and career tech ed-ucation.

The A-G requirements are college prepara-tory courses that California high school studentsneed to complete upon graduation in order toqualify for four-year colleges like CSUs andUCs. CFJ, a statewide grassroots organizationworks for racial justice by building the power ofcommunities and organizes the youth with pro-grams like SYLA. Those students are then madeaware of things like A-G requirements, by which

more sudents are notified. “I think it's a right to go to college and there’s

so many students that think just by passing theirclasses they can go to college,” said Navarro, ajunior at Independence High School. “Our com-munity is made up of a lot of immigrant parentsso they don't know of the things.”

Nearly 2/3rds of students in the ESUHSDgraduate without the necessary classes to attenda 4-year university. While only 20% of Latinostudents graduate with their required classes.

“What we really want to do is to change therequirements to graduate high school into thesame requirements needed to get into college be-cause everyone will be set," said Benjamin Long,junior at Independence High School and SYLAgraduate.

Long and Navarro didn’t know about the col-lege requirements until their sophomore year.They both hope to rearrange their schedules tobetter prepare for college.

Students, allies and community membershave rallied at the State Building to demand col-lege and career readiness for students in the ES-UHSD and a stop to devastating budget cuts. Inaddition to the resolution being presented, thecampaign leaders plan to identify the resources,support services and systems necessary to makeit a success.

"I'm in agreement that we need to get this ini-

tiative before the board,” said Interim Superin-tendent Dan Moser, ESUHSD.

Moser said that everyone should be ready forcollege after high school and made a point aboutthe importance of higher education in the future.He has support from CFJ and the different allies.

"I feel cheated that nobody told me about it

and that I took that useless class my freshmanyear," said Long. “We have to tell everyone aboutthis and change the requirements.”

Locally, CFJ organize in Independence, Sil-ver Creek, James Lick and Overfelt High School.

Es necesario alimentar el espíritu de senti-mientos nobles y positivos como: la caridad, labondad, la calidad humana, el optimismo, lasinceridad, la humildad y la honestidad. Es pre-ciso hacer el bien en cuanto podamos y nohacer a otros lo que no nos gustaría que nos hi-cieran.

Juan Hernandez came to the United States when he was15 years old without knowing a word of English. He wasa chubby kid who found it difficult to adjust to life in the

United States. That was until he discovered boxing.“I have been training Juan for the past six years, but he has

been training for the past nine years. He is 24 now and is ready to

make the transition from amateur to professional,” said Rick Nava,a volunteer boxing coach at the Redw ood City Police AthleticLeague “This sport takes a tremendous amount of discipline andhard work to get to this point.”

Hernandez is 5’9’ and fights as a cruiser weight at 194-197pounds.

“As an ama teur, he has alw ays fought people tha t weremuch bigger than him,” Nava said. “Naturally he tends to go insidefor body shots against his much bigger opponen ts. He trains bypracticing with much taller individuals and b y watching his op-ponents on YouTube.”

The reason Hernandez is turning professional is because hehas had great success as an amateur.

“He was winning a lot in the first r ound by knockout, so itonly made sense that he turn pro,” Nava said.

Nava says he has great expectations for Hernandez and be-lieves he will make an impact in the boxing world.

“Everyone around him believes he will do well because hehas great skills,” Nava said. “He has great speed and a lot of power.”

Juan is making his debut on Aug 14 at the San Mateo EventCenter (Fight Night on the Way to the Playboy Mansion, Sat. Au-gust 14, 2010).

Hernandez, Nava and some close friends put up $1,000 t omake this event happen. They will receive 20 percent from thetickets they sell and will use the money t o pay for expenses andto possibly set up Hernandez’s next fight.
