• 4 game suspension

NFL Ruling of Deflate Gate

Judge Berman’s September 3, 2015 ruling on Deflate gate case

took away Tom Brady’s 4 games suspension on the grounds that:

• No testimony was provided from the NFL General Council (Jeff Paschu)

• Tom Brady was not given notice of discipline from NFL

• NFL didn’t share investigative evidence with Tom Brady’s lawyers

Decided based on NFL’s lack of compliance with HR legal

guidelines. Centered on due process not guilt vs. innocence.

NFLPA & Goodell

NFLPA (players association) stated after ruling that NFL collective

bargaining is a much better process, and CBA does not grant the

commissioner authority to be unfair.

Commissioner Goodell is appealing Berman’s ruling in an effort to

uphold the CBA and the integrity of the game. He wants to set his own

precedence about

• NFL disciplining players from within

• Following the integrity of the game

discipline.

head coach for $500,000

• Patriots neglected to promote positive influence to players.

New York Giants– Fake Injuries (On-going)

What Happened?• New York Giants players fake injuries to slow down the game

down.

What Are the Results?• The league issued a memo of new consequences including:

• Fines, suspensions and lost draft picks.

How Did It Affect Performance Management?• The case promoted cheating cultures within the NFL.

New Orleans Saints - Bounty Gate (2009)

What Happened?• Awarded cash prizes to players who injured select members of the opposing team.

• Head coach Sean Payton was both aware and involved in the program’s cover-up.

What Are the Results?

• Head coach was suspended for 1 year without compensation.• Suspensions for all players involved ranged from 3 months to a year.

How Did It Affect Performance Management?

• Allowed the NFL to correct the coaching staff’s misuse of results criteria to

motivate their players.

The Draft, also known as the “Player Selection Meeting.”

• An annual event in which professional teams select

eligible college players to play for them

• Takes place in the middle of the off season

A board consisting of scouting experts and team executives which

makes predictions about the likely round a player would be drafted

NFL Scouting Combine

A six day assessment of skills in which college football players

perform tests in front of NFL coaches, general managers, and

scouts.

Result

Professional sports leagues are a great representation of effective performance management

Through Tom Brady’s case, the NFL culture shows through repeatedly as arrogance and status

trump player’s integrity and accountability

Performance = Winning, not cheating. NFL should address the cheating culture immediately

When organization culture aligns with its mission and values, it can assist employees in making

sense of their behaviors by providing justification for behaviors
