Esta tarifa incluye algunos avances delque será próximo catalogo 2014-15, quese presentará en la próxima feria LyonPiscina del 18-21 de Noviembre.

PSH-Pools prevé que los movimientosespeculativos en los mercados financie-ros y de primeras materias, ligados a lafuerte crisis económica mundial, no vana desaparecer en el corto plazo, y en con-secuencia es previsible la aparición denuevas variaciones a la alza o la bajatanto del dólar como de las primeras ma-terias, por lo tanto ha decidido presentaresta tarifa indexada a las cotizaciones enlos mercados internacionales existentes a13/11/2014:

• Dólar €/USA 1,1235• Barril de petróleo 48,19 $/barril

Brent• Cobre Londres 5.080,50• Hierro Lingote Afino 333 €/Tn.

De producirse variaciones en más del 5%a la alza de las primeras materias o la ba-jada de la cotización del Dólar USA enmás de un 3%; PSH-Pools se reserva elderecho de suspender la validez de lapresente tarifa.

Esperamos que todas estas fluctuacio-nes e incertidumbres sirvan para que elmercado alcance un nuevo punto deequilibrio que permita a la economía mun-dial iniciar una nueva etapa de creci-miento como parece que anuncian los re-cientes datos macroeconómicos de lasprincipales economías internacionales.

This price list includes some novelties thatwill be presented in our next catalogue2014-2015, launched at the Salon dePiscine 2014 at Lyon, France, 18 to 21November.

PSH-Pools expect that speculativemovements in the financial and raw ma-terials markets, linked to strong globaleconomic crisis, will not disappear in theshort term and therefore is likely to appearnew variations to increase or decreaseboth the dollar and/or raw materials quo-tations, therefore we decided to presentthis prices list indexed to internationalmarket prices existing at November 13,2014:

CONDICIONES COMERCIALES

PEDIDOSCon el fin de facilitar la tramitación de los pedidos y evitar posibles errores, rogamos em-plear siempre las referencias y descripciones de nuestro CATALOGO. Nos reservamosel derecho a modificar y variar nuestros productos sin previo aviso. TODO PE-DIDO DEBE SER ADELANTADO VIA FAX O EMAIL.

I. PLAZOS DE ENTREGALa cumplimentación de los pedidos se realizará dentro de los dos días a partir de la con-firmación de los mismos, siempre y cuando los materiales estén en almacén. En su de-fecto deberemos confirmar plazo de entrega.El plazo de entrega se entiende el de salida de nuestros almacenes.No se aceptan penalizaciones por retrasos.

II. TRANSPORTEII.I NACIONAL

Los portes serán pagados (y enviados por nuestra agencia de transporte)para pedidos superiores a 800 EUROS (quedando excluidos los calderinesy en general cualquier envío con mucho volumen).La mercancía siempre viaja por cuenta y riesgo del comprador.Si el cliente nos pide otra agencia de transporte será siempre a “PORTESDEBIDOS”.

II.II INTERNACIONALTodos los envios internacionales son realizados en condiciones EX-WORKS, debiendo ser el cliente quien designe la agencia de transportes.

III. EMBALAJEToda mercancía se envía con embalaje Standard. En las que por su volumen o peso re-quiera un embalaje de madera (grupos presión, contraincendios, etc…), este embalajese cobrará aparte en la factura de venta.

IV. PRECIOSNuestros precios se entienden de material situado en nuestros almacenes, siendo porcuenta del cliente los impuestos correspondientes. Cualquier gasto suplementario no pre-visto en nuestras tarifas (embalajes especiales, envíos por régimen de equipajes, avión,servicio urgente, etc…) será por cuenta del cliente y cargado en factura.Nos reservamos el derecho a modificar nuestras tarifas sin previo aviso.

V. CONDICIONES DE PAGOEl pago al contado será condición exigida en tanto no se haya formalizado la correspon-diente apertura de cuenta.Las condiciones de pago se establecerán de mutuo acuerdo y no podrán ser modifica-das sin nuestra autorización expresa.

VI. GARANTÍAPSH-2010, S.L.U. garantiza todos sus productos por un periodo de 24 meses contra de-fecto de fabricación, desde la fecha de factura.La responsabilidad de PSH-2010, S.L.U. se limita exclusivamente a reemplazar o repararlos materiales defectuosos, no atendiendo a indemnizaciones ni otros gastos.Exceptuando cualquier condición particular acordada entre las partes, el procedimientode Garantía, será el que se describe a continuación:

Toda solicitud de garantía debe ser realizada por el Mayorista o Distribuidor que haya re-alizado la venta del equipo en cuestión, al SAT respectivo o a PSH-2010, S.L.U. directa-mente, sólo si corresponde.

a) Determinación de Ejecución de Garantía:Sólo los Servicios Técnicos Autorizados (SAT) y nuestro taller de reparaciones, tienen lapotestad para determinar la ejecución o no de una garantía.

b) Documentación necesaria y obligatoria para solicitar la garantía:Copia u Original de la Factura de venta realizada por PSH-2010, S.L.U.. En el caso que laventa haya sido realizada por un Mayorista o Distribuidor, deberá ser acompañada ade-más con la factura emitida por este.

c) Producto defectuoso a la entrega del material:PSH-2010, S.L.U. asumirá los gastos de transporte de ida y de vuelta, si y sólo si: Antesde cualquier gestión, se ha ejecutado el “PROCEDIMIENTO DE DEVOLUCION DEMATERIAL”, descrito más adelante. A continuación, PSH-2010, S.L.U. restituirá el pro-ducto, el cual será facturado. Se procederá al abono del mismo, una vez se haya recep-cionado el equipo en nuestro almacén.

d) Producto defectuoso en Garantía:Una vez que la entidad autorizada haya resuelto que, la ejecución de la garantía procede,PSH-2010, S.L.U., asumirá los costes de reparación o reposición, además de los costesde transporte de vuelta del producto, siendo los portes de ida por cuenta del cliente.

e) Producto defectuoso fuera de Garantía:El servicio técnico de PSH-2010, S.L.U. facilitará presupuesto de la reparación vía fax, te-niendo que ser devuelto firmado y sellado, para proceder a la misma. Esta se llevará acabo únicamente si se cuenta con el consentimiento explícito del cliente. Los gastos detransporte serán soportados por el cliente en ambos sentidos.

f) Producto defectuoso por rotura o golpe en el transporte:Para todos lo pedidos enviados con nuestra agencia que resulten dañados durante sutransporte, el cliente procederá a anotar el defecto ocasionado y a pasar nota de ello ala agencia de tranporte y a PSH-2010, S.L.U. en un plazo inferior a 24 h. Superado esteplazo PSH-2010, S.L.U. no se responsabiliza bajo ningún concepto del defecto ocasio-nado.

PROCEDIMIENTO DE DEVOLUCION DE MATERIAL

En el caso de llevar a cabo una devolución, ya sea porque:

La mercancía ha sido dañada en el transporte.La mercancía difiere de lo solicitado.Se desea anular la compra (sólo durante los 15 días hábiles que preceden a lafecha de expedición).Debida a otra situación en particular.

El procedimiento a ejecutar es el siguiente:

- Si no dispone de la hoja que acompaña al presente procedimiento, debe solici-tarla vía Fax al 933775501 o al email [email protected]

- Devolver la hoja cumplimentada al Fax 933775501, comunicando la instancia.- El Departamento Comercial de PSH-2010, S.L.U., a través del mismo medio de-

volverá la misma hoja comunicando su resolución e indicará las instrucciones queestime conveniente.

- En el caso que la devolución sea aceptada, deberá realizarse de acuerdo a lo in-formado en la misma resolución.

- Nuestro almacén, SÓLO recibirá mercancía en devolución si se encuentra acom-pañada de los siguientes documentos.

- Solicitud de Devolución de Material, sólo con la aceptación otorgada.- Copia del Albarán del primer envío.

PSH-2010, S.L.U. se reserva el derecho de realizar un cargo o deducir una cantidad delimporte a abonar, en concepto de revisión, reacondicionamiento, reubicación y gastos degestión, si la devolución es de exclusiva responsabilidad del cliente.

COMMERCIAL CONDITIONS

ORDERSIn order to facilitate order processing and avoid any mistakes, we ask that the referencenumbers and descriptions in our CATALOGUE be used at all times. We reserve theright to alter and vary our products without prior notice. ALL ORDERS MUSTBE FORWARDED BY FAX OR EMAIL.

I. DELIVERY TIMESOrders will be met within two days of them being confirmed, providing the merchandiseis in the warehouse. Otherwise we will have to confirm the delivery date.The delivery date is taken to be that of despatch from our warehouses.No penalties for delay will be accepted.

II. INTERNATIONAL TRANSPORTAll international deliveries are made at EX-WORKS conditions. Forwarder would bedesigned by our customer.

III. PACKINGAll goods are sent with Standard packing. In cases where their volume or weight dictateswooden packing (pressure units, fire-fighting systems, etc.), this packing will be chargedseparately on the sales invoice.

IV. PRICESOur prices are for merchandise located at our warehouses, with the corresponding taxesat the customer’s expense. Any extra costs not covered by our prices (special packing,shipment as luggage, by air, urgent deliveries, etc.) must be paid for by the customer,and will be charged on the invoice.We reserve the right to alter our prices without prior notice.

V. CONDITIONS OF PAYMENTPayment in cash will be obligatory wherever the pertinent account has been opened.Conditions of payment will be established by mutual agreement and may not be alteredwithout our express authorisation.

VI. WARRANTYPSH-2010, S.L.U. guarantees all its products against manufacturing defects for a periodof 24 months from the invoice date.PSH-2010, S.L.U.’s liability is limited solely to replacing or repairing defective merchan-dise, and no compensation or other expenses will be paid.With the exception of any specific condition agreed between the parties, the Warrantyprocedure shall be as described below:

All applications under guarantee must be made by the wholesaler or distributor who soldthe equipment in question, to the respective authorised technical service (Servicio Téc-nico Autorizado, or SAT), or directly to PSH-2010, S.L.U., only where appropriate.

a) Determining Execution of the Warranty:Only authorised technical services (Servicios Técnicos Autorizados, or SAT) and our re-pair workshop are empowered to determine whether the warranty is applicable.

b) Documentation Required for a Claim under the Warranty:Copy or Original of the sales invoice issued by PSH-2010, S.L.U.. Where the sale wasmade by a wholesaler or distributor, this must also be accompanied by the latter’s invoice.

c) Defective Product upon Delivery:PSH-2010, S.L.U. will bear the costs of shipment both ways, if and only if the followingapplies: before any steps were taken, the “PROCEDURE FOR RETURNING GOODS”as described below was followed. PSH-2010, S.L.U. will then have the product returned,and this will be invoiced. This will be refunded once the equipment has been received atour warehouse.

d) Defective Product under Warranty:Once the authorised party has resolved that the warranty should apply, PSH-2010, S.L.U.will bear the cost of repair or replacement, plus the costs of sending the product backto the customer. The customer is to bear the cost of sending the product to PSH-2010,S.L.U..

e) Defective Product out of Warranty:The PSH-2010, S.L.U. engineering service will fax a quotation for the repair. This mustbe returned signed and stamped for the repair to be carried out. This can only be donewith the customer’s express consent. Shipping costs both ways are to be borne by thecustomer.

PROCEDURE FOR RETURNING GOODS

In the event of any returns, for whichever of the following reasons:

The goods were damaged in transit.The goods are not the same as those ordered.The purchaser wishes to cancel the order (during the 15 working days preceding thedespatch date only).For some other specific reason.

The procedure to be taken is the following:

- If you do not have the sheet which goes with this procedure, you can ask for oneby fax on 933775501 or by email at [email protected]

- Return the completed sheet by fax to 933775501, with your request.- The PSH-2010, S.L.U. commercial department will return the sheet by the same

means, informing you of its decision and giving whatever instructions it believesto be appropriate.

- In the event that the return is accepted, this must be effected in accordance withthe instructions in the decision.

- Our warehouse will ONLY accept returned goods if they are accompanied by thefollowing documents:

- Application to return goods, which must include acceptance of the return.- Copy of the original delivery note.

PSH-2010, S.L.U. reserves the right to make a charge or deduct an amount from the sumto be refunded, to cover inspection, refurbishment, relocation and administration costs,where the return is the sole responsibility of the customer.

CONDITIONS COMMERCIALES

COMMANDESDans le but de faciliter les démarches des commandes et éviter d’éventuelles erreurs, nousvous prions de bien vouloir toujours employer les références et descriptions de notre CA-TALOGUE. Nous nous réservons le droit de modifier et de varier nos produits sanspréavis. TOUTE COMMANDE DOIT TRE AVANCÉE PAR FAX OU PAR COURRIEL.

I. DÉLAIS DE LIVRAISONL’exécution des commandes se réalisera dans les deux jours à partir de leur confirma-tion, à condition que les matériels soient en stock. À défaut, nous devrons confirmer ledélai de livraison.Le délai de livraison est compris comme étant la date de départ des marchandises de nosentrepôts.Les pénalités pour retards ne sont pas acceptées.

II. TRANSPORTLes livraison internationaux sont efectuées dans de condition EX-WORKS. Le transportdoit être désigné par le client.

III. EMBALLAGEToute marchandise est envoyée dans un emballage Standard. Dans le cas de marchan-dise qui, en raison de son volume ou de son poids, nécessiterait un emballage en bois(groupes pression, contre-incendies, etc.), cet emballage sera facturé en sus de la mar-chandise dans la même facture.

IV. PRIXNos prix sont compris pour une marchandise située dans nos entrepôts, les impôts cor-respondants étant à la charge du client. Tout frais supplémentaire non prévu dans nostarifs (emballages spéciaux, envois comme bagages, par avion, en service urgent, etc.)sera au compte du client et donc facturé.Nous nous réservons le droit de modifier sans préavis nos tarifs.

V. CONDITIONS DE PAIEMENTLe paiement comptant sera une condition exigée tant que l’ouverture de compte corres-pondante n’aura pas été réalisée.Les conditions de paiement seront établies d’un commun accord et ne pourront être mo-difiées sans notre autorisation expresse.

VI. GARANTIEPSH-2010, S.L.U. garantit tous ses produits pour une période de 24 mois contre défautde fabrication, à partir de la date de la facture. La responsabilité de PSH-2010, S.L.U. est exclusivement limitée au remplacement des ma-tériels défectueux, sans qu’aucune indemnités ni autres frais ne puissent être pris enconsidération.Exception faite de toute condition particulière convenue entre les parties, la procédure deGarantie sera celle décrite ci-après:

Toute demande de garantie doit être réalisée par le Grossiste ou le Distributeur qui auraréalisé la vente de la marchandise en question, auprès du Service Technique Agrée (SAT)respectif ou de PSH-2010, S.L.U. directement, le cas échéant.

a) Détermination de l’Exécution de la Garantie:Seuls les Services Techniques Agrées (SAT) et notre atelier de réparation ont le pouvoirde déterminer l’exécution ou non d’une garantie.

b) Documentation nécessaire et obligatoire pour demander la garantie:Copie ou Original de la Facture de vente réalisée par PSH-2010, S.L.U.. Dans le cas où lavente aurait été réalisée par un Grossiste ou un Distributeur, la facture émise par celui-ci devra également être jointe.

c) Produit défectueux à la livraison de la marchandise :PSH-2010, S.L.U. assumera les frais d’aller et de retour uniquement si, avant toute dé-marche, la “PROCÉDURE DE RETOUR DE MATÉRIEL”, décrite plus loin, a été exé-cutée. PSH-2010, S.L.U. restituera ensuite le produit, qui sera facturé. Le remboursementde ce dernier sera réalisé une fois la marchandise réceptionnée dans notre entrepôt.

d) Produit défectueux sous Garantie :Quand l’organisme agréé aura convenu que l’exécution de la garantie a lieu d’être, PSH-2010, S.L.U. assumera les coûts de réparation ou de remplacement, outre ceux de trans-ports de renvoi du produit, les ports de son aller étant pour le compte du client.

e) Produit défectueux hors Garantie :Le service technique de PSH-2010, S.L.U. remettra un devis de la réparation par fax ;ce devis devra être retourné dûment signé et timbré pour pouvoir effectuer la réparation.Cette dernière sera menée à terme uniquement avec le consentement explicite du client.Les frais de transport seront à la charge du client dans les deux sens.

PROCÉDURE DE RETOUR DE MATÉRIEL

Dans le cas où un retour de matériel devrait être effectué, pour l’une des raisons suivantes:

La marchandise a été endommagée dans le transport.La marchandise est différente de celle objet de la commande.L’achat doit être annulé (seulement pendant les 15 jours ouvrables qui précèdentla date d’expédition).Autre situation en particulier.

La procédure à exécuter sera la suivante :

- Si vous ne disposez pas de la fiche jointe à la présente procédure, vous devrez lademander par Fax au 933775501 ou par courriel à [email protected]

- Retourner la fiche dûment remplie par Fax au 933775501, en y indiquant la ré-clamation.

- Le Service Commercial de PSH-2010, S.L.U. vous rendra, par le même moyen,cette fiche où il indiquera la résolution et les instructions qu’il estimera opportunes.

- Dans le cas où le renvoi de marchandise serait accepté, vous devrez suivre les ins-tructions qui figureront dans cette résolution.

- Notre entrepôt acceptera un marchandise retournée SEULEMENT si elle est ac-compagnée des documents suivants:

- Fiche de Demande de Retour de Matériel où figurera notre acceptation.- Copie du Bon de Livraison du premier envoi.

PSH-2010, S.L.U. se réserve le droit de réaliser un débit ou de déduire une quantité dumontant à verser, à titre de révision, remise en conditions, nouvelle localisation et fraisde démarches, si le client est exclusivement responsable du retour.
