APPLICABILITY Applicable to single‐phase and three‐phase services for individual residential premises whose load requirements do not exceed 50 kVa of transformer capacity, subject to the established policies of Sangre de Cristo Electric Association (the “Association”). Consumers eligible for service under this rate schedule have the option of being billed under Rate Schedule No. 3, Large Power Service. However, the consumer shall be billed on the chosen rate schedule for a minimum of twelve (12) consecutive months.

TYPE OF SERVICE Single‐phase or three‐phase, 60 hertz, at available secondary voltages. Written approval of the Association must be obtained prior to the installation of any single‐phase motor having a rated capacity of ten (10) horsepower or more.

SERVICE AVAILABILITY CHARGE PROVISIONS 1. Consumers within the corporate limits of towns, cities, or bona fide

mobile home courts when the owner is under contract to guarantee the service availability charge for the mobile home court shall be subject to the monthly service availability charge when service is connected.

2. Consumers outside the corporate limits of towns, cities, or bona fide mobile home courts shall be subject to the monthly service availability charge whether service is connected or disconnected, as long as service is available.

TERMS OF PAYMENT If a monthly bill is not paid on or before the due date as stated on the bill:

1. For connected accounts, the Association’s Board Policy C‐4 shall apply. 2. For disconnected accounts, all applicable service, secondary and primary

lines and apparatus may be removed in accordance with the Association’s Board Policy C‐14.

REVISIONS Revisions of this rate schedule are subject to the provisions of Board Policy A‐33.

DETERMINATION OF BILLING DEMAND

The billing demand shall be the maximum kilowatt demand established by the consumer for any period of fifteen (15) minutes during the month for which the bill is rendered as indicated or recorded by a demand meter and adjusted for power factor as herein provided.

POWER FACTOR ADJUSTMENT The consumer agrees to maintain unity power factor as nearly as practicable. The measured demand will be adjusted for consumers with 50 kW or more of measured demand to correct for average power factors lower than 90% if and when this Association deems necessary. Such adjustments will be made by increasing the measured demand 1% for each 1% by which the average power factor is less than 90% lagging.

SERVICE PROVISIONS Delivery Point: If service is furnished at secondary voltage, the delivery point shall be the

metering point unless otherwise specified in the contract for service. All wiring, poles, lines and other electric equipment on the load side of the delivery point shall be owned and maintained by the consumer.

If service is furnished at this Association’s primary line voltage, the delivery point shall

be the point of attachment of this Association’s primary line to the consumer’s transformer structure unless otherwise specified in the contract for service. All wiring, poles, lines, and other electric equipment (except metering equipment) on the load side of the delivery point shall be owned and maintained by the consumer.

1. Available to incorporated towns only: For ornamental, steel, or aluminum poles, required for street lights, a charge equal to the estimated installed cost per pole divided by 120 months, per pole per month, shall apply.

2. The Association will furnish and install a wooden pole if required for the light, for which the consumer shall pay this Association, in addition to other applicable charges, $.85 per pole per month.

3. When underground service is required, the base rate per light per month shall be increased $.95 for each 50 feet or fraction thereof of underground service required.

4. In the event a transformer is required, the Association will furnish and install same, for which the consumer shall pay this Association $1.32 per month in addition to other applicable charges.

6. At the consumer’s request the Association will install a Hubbell Sky Cap light shield on any new or existing 175W 120V mercury vapor light. If the shield is installed at the convenience of the Association, the installation charge shall be $32.00.

If the consumer requests immediate installation of such shield, the installation charge shall be $139.00.

7. In accordance with Senate Bill 139 adopted by the Colorado Legislature effective July 1, 1981, the Association surcharges electric customers within the Town of Buena Vista a percentage of their gross revenues to recover the franchise fee required by Town of Buena Vista Ordinance No. 4, Series of 1997, dated March 25, 1997. In accordance with said franchise agreement, the franchise fee shall be 1%.

8. This rate schedule shall only apply to single‐phase, 60 hertz, 120 and/or 240 secondary voltages. If a primary voltage extension is required, Board Policy C‐7 will apply to that portion of the extension considered primary voltage. Any portion of a primary extension installed solely to provide service to a light described in this rate schedule shall be considered “indeterminate service” and shall be paid as a non‐refundable contribution‐in‐aid‐of‐construction as described in II.B.2.b of Board Policy C‐7.

CONDITIONS OF SERVICE 1. Six‐foot arms will be used for town and village street lights. 2. Thirty‐inch arms will be used for individuals for dusk‐to‐dawn lights. 3. Nine‐foot (plus or minus one foot) fiberglass decorative poles shall be used for sidewalk

decorative lights. 4. The lighting equipment shall remain the property of the Association. The consumer shall

protect the lighting equipment from deliberate damage. 5. The Association will maintain the lighting equipment, including lamp replacement, at no

additional cost to the consumer after the consumer notifies the Association of the need for maintenance of the lighting equipment. If the facilities have been damaged by the consumer or his agent, charges will be made in accordance with applicable policies of the Association.

6. The consumer shall allow authorized representative of the Association to enter the consumer’s premises and to trim trees and shrubs as necessary for maintenance of the lighting equipment and for removal of the lighting equipment upon termination of service under this schedule.

7. The Association and the consumer shall execute an agreement for service under this schedule for a period of not less than three (3) years.

5. The above rates and time periods are subject to change. This rate represents a pilot program designed to accommodate and foster new and emerging technologies. The rate attempts to protect the Association from uncontrolled demand costs resulting from EV charging and to offer the consumer a cost‐effective rate for vehicle charging. Changes may be made as information and knowledge are gained about the affects of vehicle charging on the Association’s system.

SYSTEM UPGRADES

Time‐of‐use charging for a EV may require a change or upgrade to the Association’s electric system that delivers power to the consumer’s premises. Necessary service changes or upgrades shall be billed to the consumer as outlined in Board Policy C‐11.

APPLICABILITY

Applicable to all eligible consumers whose electric service is supplied by Sangre de Cristo Electric Association (the “Association”) and whose net metering and compliance application form is approved by the Association.

AVAILABILITY Net metering is available to consumers located within the Association’s service territory who own, operate, lease or otherwise control an eligible generation system.

DEFINITIONS In the context of this rate schedule, “consumer” means a consumer of the Association who owns, operates, leases or otherwise controls an eligible generating system. “Generating system” refers to the consumer’s eligible and qualified net‐metered generation. Eligible generating system: An electric generating system which:

1. has a total aggregate nameplate generating capacity, from single or multiple generators, of twenty‐five kilowatts (25 kW) or less; and

2. uses as its energy source solar, wind, biomass, hydropower, geothermal or other renewable resources; and

3. is intended primarily to offset part or all of the consumer’s electric energy requirements at the same location; and

4. is located on the premises that are owned or leased by the consumer; and

5. operates in parallel with the Association’s electric distribution system; and

6. shall not be used to offset or provide credits for electric consumption at another location of the consumer or for any other consumer; and,

7. meets all safety and performance requirements of the Association and applicable regulations and standards.

Net metering: The measured difference between the electricity supplied to a consumer by the Association and the electricity generated by the consumer and delivered to the Association at the same point of interconnection. For combination net meter and time‐of‐use (“Net Meter/TOU”) consumers, the measured difference is the same as above, and the on‐peak and off‐peak time periods will be registered separately. Net meter: A single meter capable of registering the flow of electricity in each direction.

RATES AND CHARGES The rates and charges for retail electric service to the consumer shall be based on the Association’s applicable rate tariff for the consumer’s premises. The consumer shall be billed monthly using net metering. In months when the Consumer uses more electricity than is generated by the consumer, the Association will bill the consumer based on the net metered kWh usage for the month and the terms of the appropriate rate schedule. Net Meter/TOU consumers will be billed for on‐peak and off‐peak kWh usage based on the applicable Time‐of‐Use rate schedule. In months when the consumer generates more electricity than is consumed by the consumer, the Association will carry forward to the next month a kWh credit balance for the net energy received. The consumer will be billed by the Association for the service availability charge and the other applicable charges of the appropriate rate schedule but with zero kWh usage for the month. For Net Meter/TOU consumers, kWh credit balances will carry forward in the respective time period (on‐peak and/or off‐peak). Annually, within sixty (60) days after the end of each annual period (December 31) or within sixty (60) days after the consumer terminates retail service, the Association shall pay the consumer for any remaining unused kWh credit balance accumulated during the previous year. The rate for payment shall be the Association’s most recent average cost of power. The average cost of power shall be calculated annually for the twelve‐month period ending December 31. The calculation shall be the total cost of purchased power divided by the total kWhs purchased by the Association. Net Meter/TOU consumers with a kWh credit balance at the end of the calendar year will have on‐peak and off‐peak kWh credit balances paid for each respective time period. The rate for payment shall be the same for both time periods, which shall be the most recent average cost of power as described above. RULES AND REGULATIONS Billing: The billing period to be used under this schedule shall be the customary billing period for ordinary residential or other service rate schedules. Metering equipment: Net metering under this schedule shall be accomplished using a single net meter capable of registering the flow of electricity in each direction. The consumer shall be responsible for all Association net metering expenses. Additionally, the Association may provide a single meter that registers the energy produced (“Production Meter”) to accurately monitor the output of the renewable installation. Safety: The design and installation of the consumer’s system shall comply with all applicable laws and regulations; shall meet all current and future safety and performance standards established by the Association, the National Electric Code, the Institute of Electric and Electronics Engineers, and the Underwriters Laboratories, Incorporated; and shall be approved the Association. RENEWABLE ENERGY CREDITS The consumer shall assign all renewable attributes associated with the net metered generation to the Association. REVISIONS A. Revisions of this rate schedule are subject to the provisions of Board Policy A‐33. B. The board of directors shall review and if necessary update this policy at least every five years or more frequently as circumstances warrant.

used for any period of fifteen (15) consecutive minutes of the month for which the bill is rendered, as indicated by the Association’s demand meter for those house listed as off‐peak.

POWER FACTOR ADJUSTMENT

The consumer agrees to maintain unity power factor as nearly as practicable. Demand charges will be adjusted to correct for average power factors lower than 90%. Such adjustments will be made by increasing the measured kW demand 1% for each 1% by which the average power factor is less than 90% lagging.

SERVICE AVAILABILITY CHARGE PROVISIONS

1. Consumers within the corporate limits of towns, cities, or bona fide mobile home courts when the owner is under contract to guarantee the service availability charge for the mobile home court shall be subject to the monthly service availability charge when service is connected.
