A través de la Oficina para la Resolución de Disputas, el Departamento de Educación de Pennsylvania (PDE por sus siglas en inglés) cumple con su mandato legal para establecer un sistema del proceso legal debido de educación especial. El Departamento de Educación de Pennsylvania tiene un contrato con la Unidad Intermedia de Central Susquehanna para proveer apoyo fiscal y cierto apoyo administrativo a esa oficina sin ser parte de las operaciones fundamentales. No se puede interferir ni influenciar a los oficiales de audiencias ni a los mediadores sobre ningún asunto que afecte el resultado de las mediaciones individuales y las audiencias del proceso legal debido. Esto incluye, sin limitación, interferencia o influencia de ninguna entidad, individuo, o grupo, incluyendo, sin limitaciones, a padres, grupos de defensa, distritos escolares, unidades intermedias incluyendo a CSIU, el personal de la ODR, y el PDE. Al mismo tiempo, a esos oficiales de audiencia y mediadores se les suministra apoyo administrativo, además de entrenamiento de una manera que conserve su imparcialidad a través de la ODR, que a su vez es también libre de tal interferencia o influencia. La Unidad Intermedia de Central Susquehanna (CSIU, por sus siglas en inglés) no discriminará en sus programas de educación, actividades, o prácticas de empleo, basado en la raza, color, origen nacional, género, impedimento, estado civil, edad, religión, orientación sexual, descendencia, membresía de sindicato, o alguna otra clasificación legalmente protegida. El anuncio de esta política está de acuerdo con el Título VI de la Ley de Derechos Civiles de 1964, Título IX de las Enmiendas de Educación de 1972, Sección 504 de la Ley de Rehabilitación de 1973, y la Ley de Americanos con Impedimentos de 1990. Introducción La Oficina para la Resolución de Disputas (ODR por sus siglas en inglés) provee recursos para los padres y las agencias educativas locales (LEA por sus siglas en inglés) para resolver las disputas educativas que involucran a los niños que reciben servicios del sistema de intervención temprana, a estudiantes con discapacidades (o que se cree que tienen discapacidades), y a estudiantes dotados (o que se cree que son dotados). El nombramiento de Pensilvania como “estado ejemplar” por la Oficina de los Programas de Educación Especial (OSEP por sus siglas en inglés) y el Centro para la Resolución Apropiada de Disputas de Educación Especial (CADRE por sus siglas en inglés) es un reconocimiento de la experiencia, la educación y la capacitación del personal de la ODR y los servicios de calidad provistos por la ODR.1 El listado de distribución de la ODR está disponible en http://odr-pa.org/subscribe-to-odr/.

Consejo de partes interesadas de la ODR El Consejo de Partes Interesadas (SC por sus siglas en inglés) de la ODR reúne a representantes de una amplia gama de grupos de partes interesadas para proporcionar información funcional y recomendaciones sobre el sistema de resolución de disputas de especial educación. Alcance Los empleados y oficiales de audiencias de la ODR participan como oradores en conferencias a lo largo del año como parte de la educación de las partes interesadas. La directora de la ODR (invitada por el CADRE), habló en la Conferencia de Liderazgo de la OSEP en Washington, D.C., así como en una variedad de lugares por todo el estado. Los oficiales de audiencias, por separado y en conjunto con otras personas, hicieron presentaciones en una variedad de conferencias, incluyendo en la Asociación de Directores de Pensilvania; el Simposio del CADRE; en diversos seminarios del Colegio de Abogados de Pensilvania; la Conferencia del Concilio de Administradores de Educación Especial (CASE por sus siglas en inglés) de Pensilvania; y en el Simposio de Derecho de Educación Especial de la Universidad de Lehigh. La gerente de programas de la ODR es la capacitadora principal del programa de capacitación para la resolución de conflictos titulado en inglés “Creating agreement”.

El personal de la ODR y los oficiales de audiencias colaboraron para producir videos, seminarios por internet y podcasts sobre temas relacionados a los padres y educadores. Los temas han incluido simulacros de audiencias del proceso legal debido, consejos para evitar

una audiencia del proceso legal debido, una explicación de las Conferencias para llegar a un acuerdo a través de un oficial de audiencias, y otros temas similares. El desarrollo de productos para la capacitación de padres y educadores es un proceso continuo y basado en las necesidades de las partes interesadas.

Entrenamientos para los oficiales de audiencias Los oficiales de audiencias participan cada año en un desarrollo profesional riguroso, tanto internamente como a través de asociaciones profesionales de gran prestigio. Ellos son miembros de la Asociación Nacional de Oficiales de Audiencias (NAHO, por sus siglas en inglés), y participan en el proceso de certificación. Los oficiales de audiencia asisten regularmente a la conferencia NAHO, y/o la Academia Nacional para Jueces de Derecho Administrativo y Oficiales de Audiencias Imparciales de la ley IDEA, además de numerosos entrenamientos llevados a cabo dentro del estado en donde se les pide frecuentemente que también participen como presentadores en las sesiones. El entrenamiento interno del año fiscal 2017-2018 incluyó una presentación interactiva sobre los acuerdos/la resolución de disputa alternativa y asuntos del entorno menos restrictivo. Los oficiales de audiencias asisten rutinariamente a las conferencias y presentaciones patrocinadas por el Departamento de Educación de Pensilvania (PDE por sus siglas en inglés) y la Red de Adiestramiento y Asistencia Técnica de Pensilvania (PaTTAN por sus siglas en inglés) y que están relacionadas con un sinnúmero de asuntos que afectan a los niños con discapacidades.

Proyectos de la ODR Conferencias para llegar a un acuerdo a través de un oficial de audiencias

A partir de marzo de 2017, las Conferencias para llegar a un acuerdo a través de un oficial de audiencias (HOSC por sus siglas en inglés) han sido un servicio regularmente ofrecido en toda disputa en donde se haya presentado una queja, y ambas partes están de acuerdo en proceder con una HOSC. La ODR mantiene una lista al azar de asignaciones de oficiales de audiencias para las HOSC. Cuando las partes solicitan una HOSC, el siguiente oficial de audiencias en la lista de HOSC es asignado a la HOSC (después de confirmar que el oficial de audiencias no tiene un caso abierto con la familia o con la LEA, en cuyo caso el siguiente oficial de audiencias de la lista recibirá la asignación). Cada oficial de audiencias tiene un enfoque diferente para los detalles de una HOSC, pero la misma estructura general aplica – se lleva a cabo una conversación entre el oficial de audiencia y los abogados (o el abogado de la LEA y el padre que se representa a sí mismo). Luego, el oficial de audiencias tiene una conversación separada con cada parte. En ese momento, cada HOSC toma su propia dirección, a veces se ha llegado a una resolución, a veces hay que tener más conversaciones colaborativas, otras veces hay que tener más conversaciones individuales. La HOSC puede continuar hasta que las partes sientan que ha alcanzado sus metas, o sus conversaciones pueden continuar sin el oficial de audiencias. Para el 30 de junio de 2018, ha habido 27% de llegada a un acuerdo. Para el 30 de junio de 2018, siete procesos de la HOSC están en proceso de ser sostenidos. Programa piloto de audiencias virtuales

Las audiencias virtuales, y la tecnología general de videoconferencias, es un servicio de la ODR que ha estado disponible desde junio de 2017. Usando una plataforma de videoconferencia altamente segura basada en el internet, y accesible fácilmente a través de cualquier computadora, laptop, tableta o teléfono inteligente con cámara, las audiencias virtuales permitirán que los participantes utilicen las videoconferencias para aumentar la eficacia y el acceso en el proceso legal debido de educación especial. Ya sea que la audiencia se lleve a cabo con todos los participantes y el oficial de audiencias en un lugar físico y un testigo que participe virtualmente, o que los participantes se reúnan en un lugar físico y que el oficial participe virtualmente, o que todos participen virtualmente, la tecnología permite que el proceso legal debido de educación especial sea mucho más ágil en responder a las necesidades de los participantes en un mundo en donde las nociones de procesos geográficamente basados y la “presencia física” se torna mucho más flexible. Las audiencias virtuales son completamente voluntarias, solamente cuando todos los participantes vean valor en utilizar la tecnología de videoconferencia para conducir toda la audiencia, o algunas sesiones particulares o el testimonio de un testigo particular. A medida que las audiencias virtuales son cada vez más utilizadas por casi todos los oficiales de audiencias, se está diseñando una iniciativa para recopilar información para entender mejor el uso de la audiencia virtual, y cómo se puede mejorar el uso de las audiencias virtuales.

Programa piloto de pruebas documentales

El programa piloto de pruebas documentales de la ODR continúa mientras los oficiales de audiencias reciben entrenamiento continuo. Lo más importante es que el protocolo del programa está en su estado final. Este protocolo ha sido desarrollado por tres años con extensas modificaciones en base a una cantidad significativa de información del colegio de abogados. Actualmente, esos abogados que participan en el programa piloto envían comentarios positivos casi uniformemente. Algunos abogados han solicitado una desviación del protocolo. En esos casos, el sistema es lo suficientemente flexible para que los oficiales de audiencias concedan esas solicitudes según el caso. Los oficiales de audiencias también pueden implementar el protocolo en varias plataformas de software, lo cual le permite a la ODR buscar soluciones que son fáciles de usar y de costo razonable.

Proyecto de CADRE entre múltiples estados

Pensilvania, a través de la ODR, es uno de los tres estados invitados por el CADRE para participar en una iniciativa diseñada para mejorar la participación productiva entre los centros para padres del estado y la agencia educativa estatal. Durante el año fiscal 2017-2018, la ODR permaneció activa en esa iniciativa con la participación del personal de la ConsultLine en reuniones estatales y proyectos asociados con la iniciativa. Las cohortes del estado de Pensilvania decidieron colaborar en los tres proyectos siguientes: una guía digital detallando los recursos disponibles de resolución de disputas, una publicación para padres describiendo los servicios disponibles para ellos de cada centro para padres y la ConsultLine, y un video que resume los servicios disponibles de cada organización. Estos recursos están programados para ser completados al final de la iniciativa facilitada por el CADRE en agosto y serán publicados en la página web al ser finalizados.

Proyecto de la HUNE

Durante el año fiscal 2017-2018, la ODR continuó con el contrato con Hispanos Unidos para Niños Excepcionales (HUNE) para ayudar a prestar servicios a las familias hispanohablantes de Pensilvania. La línea telefónica de ayuda llamada Spanish Help-Line Plus, establecida por la HUNE, proporcionó a las familias acceso a un especialista bilingüe de información quien contestó preguntas relacionadas a inquietudes y recursos de educación especial. El especialista de Spanish Help-Line Plus recibió entrenamiento de los especialistas de la ConsultLine.

La ConsultLine

La ConsultLine de Educación Especial es una línea de asistencia gratuita que provee información a los padres y defensores que tienen preguntas o inquietudes sobre la educación especial de niños en edad escolar. La ConsultLine está formada por cuatro especialistas quienes brindan información sobre educación especial, la educación para niños dotados y el Artículo 504 de la Ley de Rehabilitación de 1973. Los especialistas evalúan la naturaleza de la pregunta o inquietud de la persona que llama y provee información y asistencia. Ejemplos de los servicios provistos incluyen:

• Información sobre los procesos para evaluar, identificar y proveer educación especial, acomodaciones y servicios relacionados para un niño;

• Los derechos de los padres y las garantías procesales, incluyendo información sobre las regulaciones;

• Información, asistencia y acceso a los procesos estatales de quejas administrados por la Oficina de Educación Especial (BSE por sus siglas en inglés) del Departamento de Educación de Pensilvania;

• Servicios de resolución de disputas y opciones para resolver desacuerdos respecto al programa de educación especial de un niño; y

• Recursos, publicaciones, páginas web, y referidos a organizaciones relacionadas a las discapacidades.

Actividad de las llamadas

Durante el año fiscal 2017-2018, los especialistas de la ConsultLine prestaron servicios a 2,855 personas que llamaron. Los especialistas de la ConsultLine responden a las instrucciones de contacto provistas por las personas que llaman (es decir, los días y las horas cuando las personas piensan que estarán disponibles para hablar con un especialista). Los especialistas intentan devolver la llamada por lo menos tres veces durante el curso de tres días laborales. Esto ha sido un protocolo efectivo para servir de forma oportuna a las personas que llaman dado el volumen de solicitudes de servicio. A pesar de los varios cambios de personal durante el año fiscal 2017-2018, los especialistas de la ConsultLine mantuvieron un alto estándar para proveer un servicio equitativo y oportuno a las personas.

Durante el año fiscal 2017-2018, 45 personas que no hablaban inglés recibieron servicios en su idioma natal. Estos idiomas incluyeron español, vietnamita, portugués y mandarín.

Datos demográficos de las personas que llaman

Los datos demográficos fueron ofrecidos voluntariamente durante 1,432 llamadas durante el año fiscal 2017-2018. Los siguientes datos estadísticos proveen una impresión general de la actividad de llamadas a través del estado.

La ConsultLine recibió la mayor cantidad de llamadas de las siguientes regiones: Unidad Intermedia 26 de Filadelfia (217); Unidad Intermedia 3 de Allegheny (117); la Unidad Intermedia 23 del condado de Montgomery (105); Unidad Intermedia 15 del área metropolitana (Capital Area) (102); Unidad Intermedia 25 del condado de Delaware (89); y la Unidad Intermedia 22 del condado de Bucks (84).

Tipos de consultas

Los especialistas de la ConsultLine documentan los temas principales asociados con la pregunta o preguntas de la persona que llama. Durante el año fiscal 2017-2018, los temas recurrentes más regulares por orden de frecuencia estuvieron relacionados a la evaluación multidisciplinaria, la colocación educativa, el contenido del IEP, la implementación del IEP y la mediación. Otros temas de alto interés incluyeron la elegibilidad, la Sección 504, y los defensores. Los especialistas proporcionaron publicaciones, formularios, recursos de internet y otros materiales relacionados al interés de la persona que llamó en 1,576 casos; la mayoría de esta información fue entregada electrónicamente.

Proceso de resolución de llamadas y entrega de paquetes de quejas de la BSE

El Proceso de Resolución de Llamadas (CRP por sus siglas en inglés) de ConsultLine es una herramienta eficaz para la resolución de conflictos relacionados con el cumplimiento de la Sección 504 de la Ley de Rehabilitación de 1973. Durante el CRP, el especialista actúa como un canal de información entre el padre (según lo define el Título 34 del Código de Regulaciones Federales, CFR 300.30.) y la escuela; el especialista no se desempeña como defensor, tomador de decisiones, mediador ni asesor de cumplimiento.

El formato y proceso del CRP incluye un correo electrónico que resume las inquietudes de los padres relacionadas con el cumplimiento, y hasta donde se sepa, la resolución propuesta por los padres. El correo electrónico es preparado por el especialista que está ofreciendo la consulta a los padres para que el mensaje refleje con precisión la naturaleza del problema.

Una vez que el mensaje es redactado y revisado con el padre, el padre da permiso verbalmente para enviar el mensaje al administrador de la LEA que es responsable de la educación especial, al jefe de división de la BSE, y al asesor regional de la BSE. Una vez que el correo electrónico se ha enviado, la participación del especialista en el CRP termina. Durante el año fiscal 2017-2018, se ofreció el CRP a 242 personas, y los padres dieron su permiso en 121 casos.

Al padre se le envía información sobre el proceso de la queja de la BSE y el formulario de la queja estatal cuando se ha implementado el CRP, y también cuando la persona que llama lo solicita. Durante el año fiscal 2017-2018, se distribuyeron 251 formularios de quejas estatales y paquetes de información a las personas que llamaron.

Educación para estudiantes dotados Los especialistas de la ConsultLine atendieron a personas cuyas preguntas o inquietudes estuvieron relacionadas al Capítulo 16/educación para estudiantes dotados. Algunas de estas personas alegan violaciones de cumplimiento. Cuando esto ocurre, el especialista provee a la persona que llama información sobre las garantías procesales para la educación de estudiantes dotados incluyendo la opción para presentar una queja por escrito. Durante el año fiscal 2017-2018, los especialistas de la ConsultLine respondieron las preguntas de 57 personas que llamaron con preguntas o inquietudes específicamente relacionadas a la educación para dotados.

Comentarios sobre la ConsultLine

Cuando las personas que llaman proveen su información de contacto, los especialistas concluyen el servicio enviando por correo o por correo electrónico una encuesta de evaluación a la persona que llamó. La encuesta es breve y puede ser completada y devuelta de forma anónima. A los participantes de la encuesta se les pide que provean comentarios y que respondan a varias preguntas sobre su satisfacción.

Durante el año fiscal 2017-2018, se completaron 63 encuestas de evaluación; la gran mayoría fueron enviadas electrónicamente. De acuerdo con los años pasados, los resultados de la encuesta indican una tasa de satisfacción entre 96.55% y 100%. Las personas que llenan la encuesta evalúan las siguientes áreas: utilidad de la información, identificación de las opciones para resolver las inquietudes, puntualidad del servicio y satisfacción general. La siguiente muestra de los comentarios recibidos durante el año fiscal 2017-2018 es congruente con la de los años pasados.

Desarrollo profesional

El personal de la ConsultLine continúa participando en oportunidades de desarrollo profesional de alta calidad para permanecer bien informados y ser eficaces para dar información útil y recursos relevantes a las personas que llaman. Durante el año fiscal 2017-2018, las actividades de desarrollo profesional incluyeron temas de discusión con los oficiales de audiencia de la ODR; el Instituto Nacional de LRP; la Conferencia de Leyes de Educación Especial de Lehigh; la Conferencia sobre Niños Excepcionales del Instituto de Abogados de Pensilvania; y la conferencia Anual del PDE. Además, los especialistas están involucrados en actividades de alcance y colaboración con el personal de varias agencias en varias iniciativas de la ODR, la BSE, y CADRE.

Facilitación de la reunión de resolución Durante el año fiscal 2017-2018, la ODR recibió ocho solicitudes para la facilitación de la reunión de resolución (RMF por sus siglas en inglés), y tres se llevaron a cabo. Al momento de redactar este informe, había una solicitud activa para la facilitación. De las 3 que se llevaron a cabo, una produjo un acuerdo, y dos no produjeron ningún acuerdo.

Facilitación del IEP/IFSP/GIEP Solicitudes de facilitación del IEP

El programa de facilitación del IEP vio una leve disminución en las solicitudes de servicios de facilitación durante el año fiscal 2017-2018. Hubo 120 solicitudes para la facilitación del IEP. Hubo 107 solicitudes para casos de la ley IDEA para niños en edad escolar; seis solicitudes para casos de la ley IDEA para niños de 3 a 5 años de edad; seis solicitudes relacionadas a la educación de estudiantes dotados; y una solicitud sobre asuntos del Capítulo 15/Sección 504.

Hubo seis solicitudes.

En un caso, se llegó a un acuerdo; en dos casos, la parte que no hizo la solicitud se rehusó a participar; hubo dos solicitudes que luego fueron retiradas; y una solicitud para la que no se pudo localizar un facilitador.

Una reunión facilitada del IEP ocurrió en 57 casos y produjo los siguientes resultados:

La facilitación del IEP es voluntaria, así que cualquiera de las partes pude rehusarse a participar. Esto ocurrió en 46 de los casos. En 15 casos, la parte que no hizo la solicitud se rehusó a usar el servicio; en cuatro casos, la ODR no recibió respuesta de la parte que no hizo la solicitud; en 25 casos, la solicitud fue retirada; y en dos casos, la ODR no pudo encontrar a un facilitador disponible en el tiempo fijado para la reunión del IEP. Al momento de redactar este informe, cuatro solicitudes para la facilitación del IEP estaban activas. En un caso se llegó a un acuerdo parcial, en un caso no había IEP; un caso fue rechazado; y tres casos fueron retirados.

Comentarios sobre la facilitación del IEP

“El facilitador guio el proceso de forma efectiva para ayudar al equipo a mantener el enfoque en los asuntos principales.”

“Yo aprecio mucho este servicio. Me ha permitido como LEA usar una opción para cortar los problemas de raíz. La mayoría de los padres sienten que tienen la atención de alguien y que se les está tomando en serio. Aunque como director yo tomo a los padres en serio, tener a un facilitador les hace saber esto a los padres.”

“El facilitador ayudó a que la reunión permaneciera enfocada en los asuntos relevantes a la educación y las intervenciones conductuales del IEP. La reunión fue dirigida y esto ayudó a que estuviéramos enfocados solamente en el IEP y las necesidades y metas individualizadas de mi hijo.”

En el año fiscal 2017-2018, la ODR celebró acuerdos con 21 contratistas independientes para brindar servicios de mediación a padres y educadores. La mediación es voluntaria, y por lo tanto, tanto los padres como la LEA deben estar de acuerdo en participar en la mediación para que sea programada y llevada a cabo.

Solicitudes para la mediación La ODR recibió un total de 430 solicitudes de mediación durante el año fiscal 2017-2018, lo cual es levemente menor que la cantidad del período de informe anterior, lo cual es consistente con las tendencias nacionales que rigen a la mediación.

Las solicitudes para la mediación sobre educación para estudiantes dotados han disminuido levemente en este período de informe.

Las áreas con la mayor cantidad de solicitudes para la mediación fueron la Unidad Intermedia 26 de Filadelfia (70); la Unidad Intermedia 23 del Condado de Montgomery (55); la Unidad Intermedia 24 del Condado de Chester (41); la Unidad Intermedia 25 del Condado de Delaware (40); y la Unidad Intermedia 22 del Condado de Bucks (37).

PROBLEMAS DE LA MEDIACIÓN Los problemas más predominantes y recurrentes tratados durante la mediación son divididos en grupos de edad y excepcionalidades de la siguiente forma: Niños desde su nacimiento hasta los 3 años de edad: Los servicios relacionados fueron el problema más predominante.

Niños de 3 a 5 años de edad y estudiantes en edad escolar: La colocación, los servicios relacionados y los asuntos relacionados al IEP fueron los problemas predominantes. Estudiantes minusválidos protegidos/con un Plan 504: Los únicos problemas estuvieron relacionados al Capítulo 15 y la Sección 504. Educación para estudiantes dotados: La elegibilidad, los problemas con el GIEP y la evaluación fueron los asuntos predominantes. Información detallada sobre los resultados de la mediación puede encontrarse en el Anexo 1: Resultados de la mediación por unidad intermedia y distrito escolar.

Los oficiales de audiencias escribieron un total de 118 incluyendo decisiones relacionadas a solicitudes hechas en el año 2017-2018 y también a solicitudes recibidas antes del año fiscal 2017-2018.

Apelaciones ante tribunales estatales y federales Durante el año fiscal 2017-2018, se realizaron 24 apelaciones ante tribunales estatales o federales; sólo siete de estas apelaciones estuvieron relacionadas a solicitudes de audiencia del año 2017-2018, el resto correspondió a períodos anteriores. El apelante escogió el tribunal federal en 88% de las apelaciones. Las apelaciones de los padres equivalieron al 75% de todas las apelaciones recibidas. Al momento del cierre del período de informe, 20 casos estaban aún en proceso y un caso fue desestimado.

Conclusión
