EL SUPERINTENDENTE DE NOTARIADO YREGISTRO

En ejercicio de las facultades legales, en especial las otorgadas por el artículo 13, numeral 28 del Decreto 2163del 17 de junio de 201t Y

CONSIDERANDO QUE:

La Constitución Nacional en su artículo 365, consagra que: "Los servicios públicosson inherentes a la finalidad social del Estado. Es deber del Estado asegurar su prestacióneficiente a todos los habitantes del territorio nacional.

"Los servicios públicos estarán sometidos al régimen jurídico que fije la ley (. .. ). En todocaso, el Estado mantendrá la regulación, el control y la vigilancia de dichos servicios" (. .. ).

El artículo 158 del Decreto Ley 960 de 1970, dispone que los Notarios tendrán lashoras de despacho público que sean necesarias para el buen servicio y que señalela vigilancia notarial..

Mediante la Instrucción Administrativa 12 de 2001 proferida por la.Superintendencia de Notariado y Registro, se fijan para las notarías 44 horassemanales de labor, siguiendo los lineamientos de funcionamiento y atención alpúblico previstos para los establecimientos públicos del orden nacional. Ello, noimpide que el Notario establezca para sus trabajadores la jornada laboralconforme a 10 dispuesto en el Código Sustantivo del Trabajo, esto es, hasta 48horas semanales.

El precitado instructivo, igualmente establece que las notarías que por estarsometidas al sistema de turnos no laboran los sábados, deberán compensar dichotiempo en el transcurso de la semana anterior al sábado que no están de turno,para completar, de esta manera, la jornada de atención al público semanal.

La Superintendencia de Notariado y Registro, mediante las resoluciones números3459 del 30/06/2005;3915 del 28/06/2006;5827 del 15/09/2006;3433 del 28/05/2007;4418 del 29/06/2007; 4967 del 25/07/2007; 1007 del 15/02/2008;6995 de 26/08/2011;7767 de 16/09/2011, así como algunas circulares, instrucciones administrativas,estableció el sistema de turnos para la atención del servicio público que prestan losnotarios los días sábados en los CÍrculosnotariales del país en donde existe más de

una notaría. Con fundamento en ello, cada año se sigue con el orden establecido aefectos de dar continuidad en el cumplimiento de la prestación de este servicio.

Conforme a lo dispuesto en dichos actos administrativos, para el año 2011 laSuperintendencia de Notariado y Registro comunicó la secuencia de los referidosturnos para algunas de las Notarías del país, a través de las Orculares Nos. 280 y303 del 23 y 30 de diciembre de 2010.

Los turnos que se establecen tienen en cuenta la población, las necesidades de lacomunidad y el número de notarías que comprende el respectivo círculo yconforme a ello, se propone implementar de manera racional, una distribuciónequitativa para la prestación del servicio notarial los días sábados, los cuales debencumplirse por los notarios del país, sin perjuicio del que prestan algunas notaríasen cumplimiento a la jornada habitual de atención al público, previamentesolicitada por cada notario y autorizado por la Dirección de Gestión Notarialmediante acto administrativo para cumplir con el horario laboral legalmenteestablecido, en acatamiento de lo previsto a través de la InstrucciónAdministrativa 12 de 2001 de esta Superintendencia y demás normasconcordantes.

Es necesario construir un sistema ordenado y suficiente para la prestación delservicio público encomendado a los notarios del país los días sábados para el año2012 y sucesivos, que esté en capacidad de atender la demanda de maneracontinua y eficiente, razón por la cual se asignarán turnos para todos los círculosnotariales en donde exista más de una notaría, dando continuidad a los yaexistentes o fijándolo por primera vez para aquellas que no cuentan con éste.

En mérito de lo expuesto, el Superintendente de Notariado y Registro,

RESUELVE;

ARTÍCULO PRIMERO: Implementación.- Establecer el sistema de turnos para laprestación del servicio público los días sábados, en los círculos notariales del paísen donde existe más d¡!una notaría, a partir de enero del año 2012y sucesivos, dela siguiente forma:

ARTÍCULO SEGUNDO: Modificación del horario autorizado para la prestacióndel servicio.- La asignación de tumos aquí prevista para la prestación del servicionotarial, es independiente del horario de servicio habitual de aquellas notarías quese encuentran autorizadas mediante acto administrativo para laborar normalmentetodos los sábados. De acogerse al sistema de tumos, el titular del respectivo'despacho notarial deberá solicitar a la Dirección de Gestión Notarial, se emitanueva resolución que le autorice el horario de atención al público con sujeción alturno que le corresponda el día sábado.

Por la cual se establecen los turnos de prestación-del servicio los días sábados en las notarías del país para elaño 2012.

ARTÍCULO TERCERO: Publicación.- La presente resolución se fijará en lugarvisible al público de cada uno de los mencionados despachos notariales para quesea conocida por los usuarios y la ciudadanía en general y se publicará en lapágina web institucionaL

ARTÍCULO CUARTO: Derogatorias.- Este acto administrativo deroga y deja sinefecto jurídico, las resoluciones números 3459 del 30/06/2005; 3915 del 28/06/2006;5827 del 15/09/2006; 3433 del 28/05/2007; 4418 del 29/06/2007; 4967 del 25/07/2007;1007 del 15/02/2008; 6995 de 26/08/2011; 7767 de 16/09/2011, así como las circulares,instrucciones administrativas y los demás actos administrativos que le seancontrarios,

ARTÍCULO QUINTO: Vigencia.- Esta resolución rige a partir de la fecha de suexpedición y entrará en vigencia a partir del día 7 de enero del año 2012.-
